You agree that monetary damages may not provide a sufficient remedy to Mirai for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations.

Section 2. Transaction
1. Availability of Inventory
Due to the constant fluctuations in our inventory levels, some information featured on this website regarding availability and inventory levels may not be up to date.
Devices may be out of stock or in short supply. Whenever applicable, Mirai will notify the Customer accordingly.
2. Prices
Due to the extremely volatile market for certain types of electronic components, prices quoted by us may, on occasion, no longer be in effect.
Whenever such a discrepancy exists, the Customer will be advised of the discrepancy before the order is shipped. Prices stated or quoted by Mirai are quoted in U.S. dollars.
3. Payment Terms
Basic payment terms of the business through the site are T/T in advance, unless specified otherwise on both of order & invoice.
4. Delivery
All deliveries shall be FOB Korea. Title to all goods shall pass to you upon delivery to your place.
Mirai shall not be liable for delays in delivery or for failure to perform due to causes beyond the reasonable control of Mirai. In the event of any delay, the date of delivery shall be extended for a period equal to the time lost as a consequence of the delay in delivery without penalty to Mirai.
All Products shall be deemed accepted by Customer unless, within ten (10) days from Delivery, Customer shall notify Mirai in writing that such products are damaged or defective.
Any claims for shortages must be made to Mirai in writing within ten (10) days from Delivery. All returns must be authorized by Mirai and no returns may be made without Mirai’s official acceptance in writing.
6. Overdue amounts
All sums due from Customer to Mirai shall accrue interest from the date due and until such sums are paid in full at the rate equal to the lesser of fifteen percent (15%) per annum or the maximum rate allowed by applicable law.
Customer shall be responsible and liable to Mirai for all reasonable costs and expenses incurred in connection with the collection of any sums owing by Customer to Mirai including, without limitation, court costs and attorneys fees (whether or not suit is brought and at trial, appellate and post-judgment levels).
Notwithstanding any prior commitments or agreements, whether written or oral, Mirai shall have no obligation to make any further shipments and/or deliveries to Customer while Customer is in default of any of its obligations to Mirai.
Section 3. Privacy Policy
1. No use of your private information
Mirai does not collect personally identifiable information about individuals who visit our site except when the information is specifically provided on a voluntary basis.
Such instances where personally identifiable information may be gathered are contest or sweepstakes registration, the registration for Subscription sites or services and in connection with content submissions, suggestions, and transaction areas.
If you identify yourself by sending us an e-mail containing personal information, then the information collected will be solely used to respond to your message.
Mirai may contact you regarding Our Company products or related services.
Our Company customer may receive information form Our Company regarding special Our Company events, press releases, news of complementary products form our strategic partners, and/or product-specific technical information including security bulletins and notifications of upgrades.
2. Disclosure
Our Company will not sell or otherwise transfer any such personally identifiable information to individuals or entities outside of Our Company without your approval.
Users may always "opt out" of further promotional contacts at any time and be removed from our mailing by sending us your request to webmaster@miraisemi.com also, upon request, Our Company will take reasonable efforts to delete user’s personal information from its database.
It may be impossible to delete a user’s entry without some residual information because of backups and records of deletions.
Section 4. Choice Of Law And Venue
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Korea. The parties consent to jurisdiction for any action, suit or proceeding relating to this Agreement in the courts of the Republic of Korea.
